An act relating to miscellaneous agricultural subjects

New sections 15 and 16 add definitions for 'second-generation anticoagulant rodenticide' (covering brodifacoum, bromadiolone, difenacoum, and difethialone) and require the Secretary to register any such product as a restricted-use pesticide when distributed or sold in Vermont. This effectively restricts public access to these common rodent poisons.

A new subsection (e) was added to the mosquito control grant program requiring that larvicide application funded by state grants occur only after the Secretary approves treatment based on a biological assessment of mosquito larvae and pupae populations by an Agency-trained technician.

The landowner mosquito control exemption (section 1083(b)) was broadened from allowing only 'biological larvicides or pupacides' to allowing 'a properly registered mosquito control pesticide,' significantly expanding what products a landowner can use on their own property without obtaining a permit.

A new fee cap was added in section 2721(c): milk producers who exclusively transport their own bulk milk now have their license handling fees capped at $25.00 per year (previously only a general $750 cap existed for bulk milk transportation).

The 'transporter' definition in the livestock dealer chapter was broadened from 'a livestock dealer who limits his or her activity to transporting' to 'a person who transports livestock for remuneration and who does not buy or sell livestock,' removing the requirement that a transporter must first qualify as a livestock dealer.

The 'packer' definition was changed from 'a livestock dealer person who is solely involved in the purchase of livestock' to simply 'a person who is solely involved in the purchase of livestock,' decoupling packers from the livestock dealer category.

The 'forest products business' definition in the agricultural credit program was changed from 'a Vermont enterprise' to simply 'an enterprise,' removing the explicit state residency requirement for eligibility.

The 'farm operation' definition in the agricultural credit program was expanded to include businesses providing specialty services to farmers (foresters, farriers, hoof trimmers, large animal veterinarians) operating or proposing to operate mobile units, making them eligible for credit program loans.

The annual license date for agricultural warehouses under chapter 67 was changed from April 1 to January 1.

Landowners may now use any properly registered mosquito control pesticide on their own land without a permit, rather than being limited to biological larvicides or pupacides. This significantly broadens the types of chemicals a landowner can apply independently.

The unofficial version capped license handling fees at $25 per year for milk producers who exclusively transport their own bulk milk. This cap was removed in the official version, meaning such producers now pay the standard fee schedule based on volume.

The definition of 'packer' no longer requires the person to be a 'livestock dealer.' A packer is now simply any person solely involved in purchasing livestock for slaughter at their own facility. This removes a prerequisite that could have excluded some operators from the category.

The definition of 'transporter' no longer requires the person to be a 'livestock dealer.' A transporter is now simply any person who transports livestock for remuneration without buying or selling. This broadens who can operate as a transporter.

Separate statutory definitions for 'fallow deer' and 'red deer' were removed from the contagious diseases section, consolidating them under the broader 'domestic deer' definition.

The Secretary of Agriculture's authority to conduct mosquito control surveys and investigations was changed from mandatory ('shall') to permissive ('may'), giving the Secretary discretion over whether to carry out these activities.

The annual warehouse license date was corrected from 'April 1 January 1' to simply 'April 1,' removing an apparently erroneous second date.

New fee caps for milk handlers: bulk milk transportation fees capped at $750 per year, and milk producers who exclusively transport their own bulk milk capped at $25 per year (Sec. 4(c)).

New licensing fee structure for meat and poultry establishments: retail vendors pay $15 to $100 depending on processing space size; all other plants/establishments pay $150 annually; fees deposited in a special fund to offset administration costs (Sec. 6(d)).

Mosquito control survey results must now also be made available upon request to any organizations, public or private, or individuals interested in mosquito control surveillance work, not just the Department of Health and local officials.
