SB 2489 allows property owners in Texas cities with populations over 900,000 (like Houston, San Antonio, or Dallas) to seek compensation from the municipality if the city fails to enforce laws against specific public nuisances - such as public camping, panhandling, loitering, or public alcohol consumption - or if the city maintains a public nuisance. Property owners can claim either documented costs to mitigate the nuisance or the decrease in their property's fair market value, but the compensation cannot exceed the property taxes paid in the year the claim is submitted. The bill explicitly excludes cases where a municipality uses prosecutorial discretion in individual cases (with public notice) or acts under state/federal law.
