Relating to promoting, prescribing, administering, or dispensing prescription drugs for off-label use.

HB 855 creates new protections for Texas physicians and pharmacists who prescribe, administer, or dispense prescription drugs for off-label use (uses not approved by the FDA). The bill prohibits state licensing agencies from revoking, suspending, or taking other adverse action against a license solely based on off-label prescribing or discussing off-label uses with patients. However, disciplinary action is permitted if the agency proves beyond reasonable doubt that the off-label use caused physical harm to a patient within three years of the treatment. This law applies only to FDA-approved drugs and takes effect September 1, 2025.
