Relating to the determination of whether a person is intoxicated for purposes of the Texas Workers' Compensation Act.

HB 5412 amends Texas law to clarify how intoxication is determined for workers' compensation claims under the Texas Workers' Compensation Act. It defines intoxication as having an alcohol concentration meeting criminal standards or losing normal mental/physical faculties due to specific substances (alcohol, drugs, volatile chemicals, or regulated similar substances). The bill creates a rebuttable presumption of intoxication when autopsy blood/urine tests detect these substances, but this presumption can be overcome only by credible, objective evidence showing the person was not intoxicated. This change applies only to injury claims occurring on or after September 1, 2025.
