Relating to the authority of certain counties to regulate subdivision platting in regard to the use of groundwater.

HB 4637 requires counties with populations between 44,001 and 44,499 to enforce a minimum 3-acre lot size for new residential or commercial subdivisions on tracts over 50 acres if groundwater is the primary water source. It mandates that developers include a water availability report with their plat applications and allows county commissioners courts to grant variances if projects include rainwater collection systems. The law applies only to counties meeting the population threshold and excludes land in certain existing water districts. It expires on August 31, 2035, and takes effect September 1, 2025.
