Relating to solicitation of patients and other prohibited marketing practices, the establishment of the task force on patient solicitation, and the prosecution of certain related criminal offenses.

Establishes a new Task Force on Patient Solicitation with eight members appointed by the executive commissioner and attorney general to study and recommend ways to prevent prohibited marketing practices.

Amends Section 164.006 to add new restrictions on contracting with marketing providers and intervention/assessment services that make referrals to treatment facilities.

Adds new requirements for disclosure when employees, agents, or contractors make referrals, including written authorization from governing authorities and disclosure at initial contact.

Increases civil penalty amounts from $1,000 to $2,000 minimum and up to $25,000 maximum per violation for prohibited solicitation acts.

Sets the effective date of the Act as September 1, 2025.

Creates new definitions and restrictions around qualified mental health referral services and marketing providers in the context of patient referrals.
