Relating to the provision of contraception to students at public institutions of higher education.

HB 3769 requires Texas public universities to provide free condoms to students in all residence hall rooms and accessible locations, as well as in public women’s and all-gender restrooms within residence halls. It also permits institutions to offer over-the-counter birth control options approved by the FDA, in addition to condoms. The law applies to all students enrolled at public institutions of higher education and takes effect for the 2025-2026 academic year. This is a direct policy change mandating accessible contraceptive availability on campus, not a procedural or commemorative measure.
