HB 2706 modifies Texas law governing when a government entity or agency can take possession of property during a condemnation lawsuit. It generally requires condemnors (like cities or counties) to wait 180 days after a special commissioners' award, pay damages, and post financial guarantees (bonds) before taking possession, unless they are a government entity. Government entities (state, counties, municipalities, or water districts) can take immediate possession after paying damages without posting bonds. The bill also allows parties to agree in advance to immediate possession. This law applies only to condemnation cases filed on or after September 1, 2025.
