SB 531 Tennessee Senate · 114th Regular Session (2025-2026)

Tennessee Bureau of Investigation - As enacted, requires the bureau to classify offenders and determine whether the offender's offense qualifies as a sexual offense, violent sexual offense, or a violent juvenile sexual offense, and whether the offender is an offender against children; allows the bureau to rely on investigative reports, files of certain prosecutorial entities, court records, or other credible information to classify an offender; requires the bureau to notify the offender of the classification. - Amends TCA Title 40.

SB 531 requires the Tennessee Bureau of Investigation (TBI) to classify individuals required to register as sexual offenders under Tennessee law into specific categories: sexual offender, violent sexual offender, violent juvenile sexual offender, or an "offender against children." The TBI may use investigative reports, court records, prosecutorial files, or other credible information to determine these classifications. The bill mandates that the TBI notify each offender of their assigned category. This applies directly to registered offenders under Tennessee Code Annotated sections 40-39-202 or 40-39-203(a)(2).
