SB 2743 Tennessee Senate · 113th Regular Session (2023-2024)

Local Government, General - As enacted, requires a political subdivision to provide a written attestation with the political subdivision's annual audit to the comptroller of the treasury certifying that the political subdivision has not sought or received a grant in intentional pursuit of certain prohibited policies. - Amends TCA Title 4; Title 5; Title 6; Title 7; Title 20; Title 21; Title 27; Title 28 and Title 29.

This new law requires local governments in Tennessee to include a written statement with their annual audit confirming they have not sought or accepted grants to pursue specific policies related to private property rights. If a local government is found to have violated these rules, individuals can file a lawsuit in court to challenge the action. A court that rules in favor of the individual will award them court costs, attorney fees, and potentially actual or punitive damages. The law applies to various state code titles governing local government operations and takes effect on July 1, 2024.
