modify the annual fee for concentrated animal feeding operations and to establish an application fee.

New annual fees are established for CAFOs based on animal type and size, ranging from $0.0011 per chicken to $0.172 per dairy cow, with a flat $1,000 fee for livestock auctions and $250 for large operations in other states or Indian country.

A new administrative subfund is created within the environment and natural resources fee fund to collect and manage fees for administering the CAFO program, with unexpended funds remaining in the subfund until appropriated.

A new $600 application fee is imposed for water pollution control permits, applicable for new operations, increases in animal numbers, manure storage capacity, land application fields, or subsequent permit submissions.

Section 34A-2-125 is repealed, removing the previous regulatory requirement it contained.

Fees accrue on July 1st each year and are due by September 30th, with the Department of Agriculture and Natural Resources submitting bills to obligated parties by August 1st.
