HR 346 United States House · 118th Congress

NOTAM Improvement Act of 2023

The NOTAM Improvement Act of 2023 requires the Federal Aviation Administration (FAA) to establish a task force within 180 days to review and improve the system for delivering flight safety notices (NOTAMs) to pilots. The task force, including representatives from airlines, airports, pilot and dispatcher unions, and aviation safety experts, will evaluate current practices and recommend ways to make notices more accurate, timely, and user-friendly. The FAA must also implement a new Federal flight safety notice system by September 30, 2024, including a backup system and a plan for global standardization with international aviation formats. The task force must submit its recommendations to Congress within one year, focusing on enhancing safety information delivery for pilots and air traffic operations.

MODERATE
The Enrolled version of HR 346 adds a new Section 3 requiring the FAA to complete implementation of a Federal NOTAM System (FNS) and a back-up system by September 30, 2024, plus brief Congress on plans for machine-readable ICAO-format delivery. It also expands the Task Force to include aircraft dispatcher union representatives, broadens the NOTAM definition from a cross-reference to a full statutory definition, and adds a rule of construction preventing duplication of existing FAA efforts.
Scope change
The bill's scope expanded significantly with the addition of Section 3, which imposes concrete implementation deadlines on the FAA (September 30, 2024) for building and backing up a Federal NOTAM System, and requires congressional briefings on international harmonization plans. This moves the bill beyond merely studying NOTAM issues to mandating specific system deliverables.
REQUIREMENT

New Section 3 requires the FAA Administrator to complete implementation of a Federal NOTAM System (FNS) by September 30, 2024, implement a back-up system to the FNS, and brief both relevant congressional committees on a plan to deliver machine-readable, filterable information in ICAO format for global harmonization with neighboring Air Navigation Service Providers.

Task Force duties were broadened: 'presenting' was changed to 'publishing' throughout; the review scope in duty (2) now explicitly includes 'systems, and international standards'; recommendation (4)(B) now requires NOTAMs to be 'complete, accurate, timely, relevant to safe flight operations, and contain pertinent information' rather than just 'contain the proper information.'

DEFINITION

The definition of NOTAM was expanded from a brief cross-reference to FAA Order 7930.2S into a full statutory definition: a notice containing information not known sufficiently in advance to publicize by other means, concerning the establishment, condition, or change in any component or hazard in the National Airspace System, the timely knowledge of which is essential to personnel concerned with flight operations.

SCOPE

A new rule of construction (subsection h) states that nothing in the section may be construed to require the FAA to duplicate any prior, ongoing, or planned efforts related to NOTAM improvement, including implementing previously enacted requirements.

ELIGIBILITY

The Task Force composition was changed: a new member category for labor union representatives of aircraft dispatchers was added as item (4), shifting all subsequent items down by one position. The total membership increased from 9 to 10 categories.

TECHNICAL

The applicable law exemption was made more specific, changing from a general reference to the Federal Advisory Committee Act (5 U.S.C. App.) to a precise citation of Chapter 10 of title 5, United States Code.
