MODERATE
This bill modifies Oregon's medical assistance recovery laws to create a new exception preventing the state from recovering medical assistance costs from an individual's estate when a child lived in the home and provided care for at least two years before eligibility or death. The bill also clarifies rules about property transfers and adds requirements for federal approval before the changes take effect.
Scope change
The bill narrows the scope of estate recovery by adding specific exemptions for children who provided care, while also removing a previous prohibition on property transfers that was causing confusion.
ELIGIBILITY

Creates new exception preventing estate recovery when a child lived in the recipient's home for at least two consecutive years before eligibility or death and provided care that allowed the recipient to stay at home rather than in an institution.

Changes the age/disability criteria for children from 'under 21 or blind or permanently disabled' to include children who meet specific care and residence requirements regardless of age or disability status.

REQUIREMENT

Removes the blanket prohibition against property transfers without adequate consideration that was previously in the law.

Requires Oregon Health Authority and Department of Human Services to seek federal approval before the new provisions become operative.

TIMELINE

Changes effective date from 91 days after legislative adjournment to the date federal approval is received, with agencies required to seek approval within six months of the act's effective date.

SCOPE

Removes references to ORS 411.708 from the bill's scope, indicating this provision is no longer being amended.
