What changed between versions
Changed the effective date for subsection (4) from January 1, 2024 to January 1, 2026, delaying when certain expunction eligibility rules apply to adults who were 18 or older at that time.
Added a requirement that the juvenile department or subject person must serve a copy of the expunction application on the district attorney, who then has 30 days to file a written objection if they believe the person doesn't meet eligibility criteria.
Added a requirement that the juvenile department make a reasonable effort to notify victims when filing expunction applications for adjudications that occurred before January 1, 2026.
Modified eligibility criteria for subsection (3) to require that the subject person is not currently within juvenile court jurisdiction, replacing the previous requirement that they had never been found within jurisdiction.
Added a new restriction preventing juvenile departments from filing expunction applications for certain serious offenses (acts that would constitute felonies or misdemeanors involving violence if committed by an adult).
