New legislation defines commercial solar energy facilities and establishes requirements for facilities on state-owned land
Solar facilities must be built on permanent grass suitable for livestock grazing and allow grazing access
Solar panels must be at least 6 feet high from ground level with 25 feet spacing between rows
Facilities must be at least 500 feet from occupied residences unless waived in writing
Solar facility owners must pay ad valorem taxes on improvements by December 31 each year
Corporation Commission authorized to enforce provisions and assess fines and fees
Applies to facilities of 10 megawatts or larger and projects in development without interconnection agreements
Effective date changed from July 1, 2025 to immediate effect upon passage and approval
