SB 746 requires political campaigns, including candidates, committees, and PACs, to clearly disclose when AI-generated images, videos, or audio depicting real people in election-related content (like ads or campaign materials) is used. The disclosure must be prominent - visible in readable text for visuals, audible throughout video/audio, or spoken at start/end for audio - stating "Created in whole or in part with the use of generative artificial intelligence." Exceptions apply to bona fide news coverage, media with good-faith verification efforts, news publications, and satirical content. Violators could face lawsuits for damages or injunctions.
