AN ACT to create and enact a new subsection to section 12.1-27.1-01 and two new sections to chapter 12.1-27.1 of the North Dakota Century Code, relating to the definition of a public library, required safety policies and technology protection measures, and the state's attorney's review of public libraries, school districts, and state agencies for compliance with statutes protecting minors from explicit sexual material; to amend and reenact subsection 5 of section 12.1-27.1-01, subsection 2 of section 12.1-27.1-03.1, and sections 12.1-27.1-03.5 and 12.1-27.1-11 of the North Dakota Century Code, relating to obscenity control; to provide for a report to the legislative management; and to provide a penalty.

Updated the bill's section number from 25.0552.05000 to 25.0552.06000 to align with the reengrossed version.

The definition of 'public library' was changed to apply only to libraries established under chapter 40-38, removing the broader definition based on funding sources.

The definition of 'nude or partially denuded human figures' was shortened, removing specific details about female breasts and buttocks.

The criminal penalty for willfully displaying objectionable materials to minors was removed from the bill.

The attorney general's role was changed from conducting reviews to simply reviewing compliance.

The requirement for libraries to receive and respond to requests regarding explicit material was replaced with a new process involving a diverse decision-making committee.

The deadline for developing policies and submitting compliance reports was updated from January 1, 2024, to January 1, 2026, and May 1, 2024, to May 1, 2026.
