AN ACT to create and enact a new chapter to title 23.1 of the North Dakota Century Code, relating to onsite wastewater treatment systems; to amend and reenact sections 23-35-02 and 23-35-08 of the North Dakota Century Code, relating to the powers and duties of the boards of health and public health units; to repeal sections 23-35-02.2 and 23-35-02.3 of the North Dakota Century Code, relating to the onsite wastewater recycling technical committee; to provide for a legislative management report; to provide a penalty; and to provide an appropriation.

Created new chapter 23-18-01 establishing comprehensive regulations for onsite wastewater treatment systems

Repealed sections 23-35-02.2 and 23-35-02.3 that governed the onsite wastewater recycling technical committee

Added requirement for public health units to conduct onsite wastewater inspections within one business day of request

Established new licensing requirements for individuals installing or servicing onsite wastewater systems

Created appeal process to department of environmental quality for permit or license denials

Added exemption for individuals installing systems on their own premises for personal use

Established new penalty of class B misdemeanor for violations of wastewater treatment regulations
