AN ACT to create and enact a new section to chapter 50-25.1 of the North Dakota Century Code, relating to an exemption for postpartum exposure to controlled substances and alcohol; to amend and reenact sections 50-25.1-16 and 50-25.1-17 of the North Dakota Century Code, relating to reporting requirements for prenatal exposure to controlled substances and alcohol abuse and toxicology test requirements; and to repeal section 50-25.1-18 of the North Dakota Century Code, relating to reporting requirements for prenatal exposure to alcohol misuse.

Added a new section establishing reporting requirements for postpartum exposure to controlled substances or alcohol misuse, extending protections to the post-delivery period.

Modified reporting exemptions to clarify that healthcare providers are exempt from reporting when providing treatment services, but must report if the woman discontinues care or continues substance abuse.

Updated toxicology testing requirements to allow testing of newborns without parental consent when there is medical evidence of prenatal substance exposure.

Maintained immunity from liability for physicians who administer toxicology tests in good faith under established protocols.
