AN ACT to amend and reenact subsection 1 of section 54-52-05 of the North Dakota Century Code, relating to employee participation in the public employees retirement system; to provide for retroactive application; and to declare an emergency.

Clarified that political subdivision employees must state in writing if they concur in the plan when the subdivision joins, and all future eligible employees must be enrolled within the first month of employment.

Created new provision allowing retired employees who are rehired with a different employer to elect to permanently waive future participation in the retirement plan and retiree health program.

Added provision that retired employees rehired with their original employer may maintain retirement status if appointed to an unclassified state position by an elected official.

Added requirement that employees not enrolled when eligible must be enrolled immediately upon notice of eligibility, unless they waive their right in writing to avoid past service contributions.

Established retroactive application date of December 14, 2024, and declared the act an emergency measure.
