AN ACT to create and enact a new subsection to section 43-17-27.1 of the North Dakota Century Code, relating to physician continuing education requirements; to amend and reenact section 14-02.1-04 of the North Dakota Century Code, relating to limitations on the performance of an abortion; to provide an appropriation; to provide an effective date; and to declare an emergency.

Physicians performing abortions must have admitting privileges at a hospital within 30 miles of the abortion facility and staff privileges to replace hospital on-staff physicians.
Abortion facilities must have a staff member trained in cardiopulmonary resuscitation present at all times when abortions are scheduled.
Physicians must review educational information created under section 43-17-27.1 within two years before performing an abortion (changed from one year).
Abortion facilities must offer women an opportunity to view an active ultrasound at least 24 hours before the procedure, with specific quality standards for the image.
A new educational course requirement is established for physicians engaging in obstetrics practice, to be developed through contract with specific experience requirements.
A $50,000 appropriation is created for the Office of Management and Budget to develop an instructional course on relevant medical and legal chapters.
The effective date for Sections 1 and 2 is set to January 1, 2026, with Section 3 (appropriation) declared as an emergency measure.
