AN ACT to amend and reenact sections 15.1-09-33 and 15.1-19-03.1 of the North Dakota Century Code, relating to a requirement for public school students to have the opportunity to recite the pledge of allegiance each morning and immunity for liability stemming from the recitation of the pledge of allegiance.

School boards may adopt policies requiring students to have the opportunity to voluntarily recite the Pledge of Allegiance at the start of each school day.

Students cannot be required to recite the Pledge of Allegiance, stand during recitation, or salute the American flag.

Clarified that school boards may allow up to one minute of silence for meditation, reflection, or prayer at the beginning of each schoolday.

Added provision that school boards may authorize voluntary recitation of the Pledge of Allegiance by teachers or students.

School boards now have explicit authority to suspend school district personnel under specific conditions.
