AN ACT to amend and reenact sections 49-02-26, 49-02-29, and 49-02-31 of the North Dakota Century Code, relating to renewable electricity and recycled energy credits; and to repeal section 49-02-30 of the North Dakota Century Code, relating to energy from hydroelectric facilities.

Hydroelectric facilities with an in-service date before January 1, 2007 are no longer eligible for renewable electricity and recycled energy credits unless they underwent repowering or efficiency improvements after August 1, 2007.

Renewable energy and recycled energy certificates can now be acquired from out-of-state facilities to help meet the state's renewable energy objective.

Section 49-02-30, which specifically governed energy from hydroelectric facilities, has been repealed and its provisions integrated into the broader renewable energy credit sections.
