AN ACT to amend and reenact subsection 1 of section 23-09.3-01.1 and subsection 1 of section 23-16-01.1 of the North Dakota Century Code, relating to the moratorium on basic care and nursing facility bed capacity.

Establishes a moratorium period from August 1, 2023 to July 31, 2029 during which no new basic care or nursing facility beds can be added to the state's licensed capacity.

Creates specific exceptions allowing new basic care beds if facilities convert existing nursing beds, transfer capacity under specific sections, demonstrate lack of available services in the area, or receive department approval.

Limits nursing facilities to no more than two reconfigurations of bed capacity (including delicensing, relicensing, converting between bed types, or reverting changes) within any twelve-month period.
