AN ACT to create and enact a new section to chapter 26.1-36 of the North Dakota Century Code, relating to individual and group health insurance coverage of insulin drugs and supplies; and to amend and reenact section 54-52.1-04.18 of the North Dakota Century Code, relating to health insurance benefits coverage of insulin drugs and supplies.
What changed between versions
New requirement that health benefit plans limit out-of-pocket costs to $25 per 30-day supply for insulin drugs and $25 for insulin-related medical supplies.
Added provisions preventing pharmacy benefits managers or distributors from charging individuals more than the $25 limits and prohibiting cost-sharing structures that would exceed these amounts.
New definitions for 'Insulin drug' and 'Medical supplies for insulin dosing and administration' that specify what products are covered and excluded (e.g., insulin pumps and continuous glucose monitors are excluded from these limits).
Removed the expiration date of July 31, 2025 from the existing section, making the insulin coverage requirements permanent.
Added an exception for qualified high-deductible health plans until enrollees meet the minimum deductible under federal tax code section 223.
