Relates to additional damages recoverable for the use of a deadly weapon
This bill allows families to recover additional damages in wrongful death lawsuits when a deadly weapon was intentionally and premeditatedly used to cause death. It specifically adds recoverable damages for grief or anguish, loss of companionship and family support, and loss of parental guidance or education. These new damages are in addition to existing claims under the law and include interest on the award from the date of death. The law applies to all cases filed after its effective date, which is immediate upon enactment.
