A 5026 New York Assembly · 2025 Regular Session

Requiring that certain sellers of real property provide a certificate of occupancy to the purchaser of the real property

This bill requires sellers of residential properties to provide buyers with a copy of the property's certificate of occupancy (issued within 30 days of ownership transfer) before finalizing the sale. It applies to most home sales but excludes transfers to relatives, court-ordered sales, municipal transfers, or properties without dwellings. Any agreement attempting to waive this requirement would be void under the law.
