Relates to the provision of breast pumps to certain incarcerated birth parents and allowing children to remain with their incarcerated birth parent for a period of time

The definition of a breastfeeding parent was changed to include any incarcerated parent able to produce breast milk, removing the prior requirement that they must be living with a child under 36 months of age.

Facilities are now required to provide personal double electric pumps and manual pumps that the parent is permitted to keep upon release or relocation.

New restrictions were added stating that personal possession of pumps can only be limited if it poses a serious risk of bodily harm, and such restrictions must be the least restrictive means necessary.

The previous requirement allowing parents to designate a community individual to gather breast milk was removed from the list of guaranteed rights.

Correctional personnel must now contemporaneously document in writing the specific facts justifying any decision to restrict a parent's possession of a breast pump.
