Relates to assignment from a decedent's estate to a transferee for value in exchange for cash or other consideration
What changed between versions
The new section was renumbered from section 2116 to section 1425 of the Surrogate's Court Procedure Act, changing its placement within the statute.
All references to 'the court' were changed to 'the surrogate's court' in subsections 4(a), 4(d), 4(e), and 7, making the responsible court more explicit.
Subsection 1 was reworded from a mandatory statement ('shall be in the form of a written agreement and shall be subject to the provisions of this section') to a simpler applicability statement ('This section applies when...').
Minor drafting corrections throughout: 'such provision shall be deemed null and void' changed to 'that provision shall be null and void'; 'this subdivision' corrected to 'this paragraph' in subsection 5(d); list conjunction changed from 'and' to 'or' before the final item in subsection 6; capitalization standardized at the start of sub-subsections.
The short title was changed from 'assignments from a decedent's estate made to a transferee for value' to 'certain assignments to a transferee for value,' using slightly narrower language.
