The legislation also allows cemetery boards to use a portion of the fund's net appreciation or, under specific conditions, some of the principal for current expenses, provided they follow strict investment standards and give the cemetery board at least sixty days' notice. Additionally, the bill establishes a "safe harbor" rule that deems certain levels of principal usage as prudent, while requiring any court-ordered use of principal to be repaid as a loan unless the cemetery can prove it lacks sufficient future revenue.
