What changed between versions
A brand-new Section 3 was added requiring all individuals voting in federal elections to present a valid physical photo identification (state driver's license, state ID card, US passport, DoD/VA ID, or tribal ID). In-person voters who lack ID may cast a provisional ballot but must present ID or a religious objection affidavit within 3 days. Mail and other non-in-person ballots require a copy of photo ID, last four SSN digits with an affidavit, or notarization. Exceptions apply for uniformed services voters and elderly/handicapped voters. States must also provide free public access to digital imaging devices for copying IDs and notify registrants of the requirement. Effective 90 days after enactment.
The occupational exception in Section 13152(c)(1) was narrowed. Previously, a spouse or dependent child could trade a covered investment if it was 'on behalf, or for the benefit, of any person other than a covered individual.' Now the exception requires that the investment is 'not owned by a covered individual' AND the trade is 'performed as a function of the primary occupation' of the spouse or dependent child. This closes a potential loophole where trades benefiting third parties could be made without the occupational connection.
The dividend reinvestment exception in Section 13152(c)(2) was tightened. Previously it covered any transaction 'made for the purpose of reinvesting dividends received from such covered investment.' Now it requires the reinvestment be 'into the same covered investment automatically or without delay,' preventing a covered individual from using the exception to redirect dividend proceeds into a different security.
Section 13153(e) on DOJ referral was clarified to refer to a 'former Member of Congress' rather than a 'Member of Congress,' making explicit that the referral authority applies after the member has left office and failed to pay an assessed fee.
The table of contents in Section 2(a) changed 'Penalties' to 'Enforcement' to match the actual section title, and various formatting and spacing corrections were made throughout. The term 'covered asset' was corrected to 'covered investment' in the withdrawal provision for consistency.
