TIME LIMIT FOR PROSECUTING CERTAIN CRIMES

SB 74 removes the statute of limitations for prosecuting human trafficking cases in New Mexico, meaning prosecutors can pursue charges at any time after the crime occurs. It also raises the age for "sexual exploitation of children by prostitution" from 16 to 18 years old and adds human trafficking to the definition of "racketeering." The bill prohibits certain defenses in human trafficking prosecutions and expands protections for victims under the Victims of Crime Act. The bill was referred to committees but was postponed indefinitely on June 3, 2025, and is currently inactive.
