Permits non-instructional staff member retired from PERS to return to employment in school district for up to two years without reenrollment in PERS if employment commences during remainder of 2025-2026 and entirety of 2026-2027 school years.

This bill allows retired non-instructional school staff (e.g., cafeteria workers, maintenance staff) who left the Public Employees’ Retirement System (PERS) to return to work for their former school district in a "critical need" position without rejoining PERS. It permits a one-year initial contract, renewable for one additional year, for a maximum of two years total employment per school district (with possible Commissioner approval for extensions). To qualify, the return to work must begin after 120 days post-retirement, during the remainder of the 2025-2026 school year and all of the 2026-2027 school year, and the school district must prove the position’s critical need. The retired staff retain their PERS retirement benefits while earning a salary during this reemployment period.
