If a renter opts out and drives through a toll plaza without cash payment options (and without their own device), the company may charge a fee up to $5 (capped at three times the actual toll cost). Companies must clearly disclose all toll-related fees and terms in rental agreements and obtain written consent before using their transponder. Violations would be treated as consumer fraud under New Jersey law, potentially resulting in fines up to $20,000 per offense. The fee provision will only apply once additional toll facilities without cash payment options are operational.
