A 4688 New Jersey General Assembly · 2026-2027 Regular Session

Excludes biomass, solar, and wind energy systems located on rooftops or exception areas from certain size restrictions applicable to preserved farmland.*

This bill allows owners of preserved farmland in New Jersey to install biomass, solar, and wind energy systems on rooftops, unpreserved farmland, or designated exception areas without being subject to certain size restrictions that normally apply to preserved farmland. The legislation permits these energy facilities as long as they do not significantly interfere with agricultural production, are owned by the landowner, and are used to power the farm or reduce its energy costs through net metering. Landowners must still obtain approval from a committee before construction, and the committee must consider input from development easement holders before making a decision. The bill also requires that energy generated from these facilities be sold only through net metering or similar agreements, and it mandates that projects in the Pinelands area comply with existing Pinelands Protection Act standards.

MINOR
The First Reprint of A4688 narrows the scope of the size-restriction exemption for biomass, solar, and wind energy facilities on preserved farmland. The exemption no longer applies to facilities located on unpreserved farmland; it now covers only rooftop installations and exception areas. The bill was reported by the Assembly Agriculture and Natural Resources Committee on May 4, 2026, with this amendment.
Scope change
The exemption from preserved farmland size restrictions was narrowed: it no longer applies to energy facilities on unpreserved farmland, limiting the exemption to rooftop installations and exception areas only.
SCOPE

Removed 'on unpreserved farmland' from the list of locations exempt from size restrictions (annual energy generation capacity limit and one percent land-use cap). Only rooftop installations and exception areas remain exempt.

TECHNICAL

The STATEMENT section at the end of the bill was removed, which is standard when a bill is reprinted after committee action.

Bill designation updated from 'A4688' to 'A4688 1R' with '[First Reprint]' added, and current version text updated to reflect committee report date of May 4, 2026.
