What changed between versions
The bill now applies only to retired school business administrators, removing superintendents, other administrators, and nurses from coverage.
The original approach of amending N.J.S.18A:66-53.2 to remove the two-year cap and allow unlimited annual renewals without Commissioner approval was replaced with a new standalone section supplementing chapter 66 of Title 18A.
Reemployment is limited to positions of critical need as determined by the Commissioner of Education, on a contractual basis for terms of not more than one year.
The superintendent must demonstrate to the board of education the need for reemployment prior to the board acting on it.
A reemployed retired school business administrator shall not obtain tenure, and any previously obtained tenure or seniority rights do not apply during the period of reemployment.
A 120-day exception: if the former member is reemployed within 120 days of retirement by the same employer from which they retired, the normal cancellation, reenrollment, and additional retirement allowance provisions still apply.
Contracts may be renewed annually but no renewal may provide the former member an election regarding whether to be reenrolled in the pension fund.
The provision is effective only if the qualified status of the retirement system under federal law can be maintained upon its application.
