It prohibits employers from refusing to hire, firing, or taking adverse employment actions against employees who use cannabis outside of work hours, with limited exceptions for safety-sensitive roles. Employers may conduct drug tests only with reasonable suspicion of impairment during work hours or after workplace accidents, using scientifically reliable testing methods. The bill also establishes standards for Workplace Impairment Recognition Experts to help employers assess employee impairment, though employers aren't required to use these experts. Exceptions permitting workplace restrictions include critical infrastructure facilities, public utility work, or roles requiring federal compliance.
