A 2626 New Jersey General Assembly · 2024-2025 Regular Session

Revises timeframes for issuance of certain construction permits by DEP in 90 days.

This bill amends New Jersey's "90-Day Law" (P.L.1975, c.232) to set a 90-day deadline for the Department of Environmental Protection (DEP) to approve, conditionally approve, or disapprove certain construction permits. It limits extensions beyond 90 days only when seasonal or weather-dependent information is needed, requiring the DEP to request such extensions at least 15 days before the deadline. If the DEP cannot obtain weather-dependent information within the timeframe, the permit is automatically deemed approved. The law applies to permits for waterfront development, coastal wetlands, CAFRA projects, stream encroachments, and flood hazard areas.
