The House version's detailed genetic definitions were removed entirely. The House defined 'female' as lacking a functional Y chromosome (referencing the SRY gene) and 'male' as anyone not meeting the female definition, including specific language about intersex persons with 46,XX/46,XY karyotypes. The Senate simply defines 'biological sex' as 'the male and female biological sexes' with no genetic criteria.

The House version's modification to the existing 'gender identity' definition (RSA 21:54) was removed. The House had added language making it an 'improper purpose' to assert gender identity to access female-only spaces or services. The Senate version does not touch the gender identity definition at all.

The House version's mandates requiring sex-based separation in public schools, municipally owned buildings, and correctional facilities were removed. The Senate version explicitly states that no public or private entity is required by state statute to separate persons based on biological sex.

The Senate version adds a 60-day effective date after passage, which was not present in the House version.

The entire willful trespass provision (a man entering female-designated areas or services) was removed from both the analysis and the statement of findings. This eliminates the criminal enforcement mechanism for accessing sex-segregated spaces.

Requirements for schools and municipalities to designate bathrooms and locker rooms as male/female facilities, including the option to provide all-gender facilities in excess of code or with a 3/5 affirmative vote of registered voters (up to 20% of fixtures), were removed.

Provisions allowing other places of public accommodation to provide sex-restricted bathrooms and locker rooms, with non-restricted facilities designated as all-gender, were removed.

A new section (RSA 21:54) defines 'gender identity' and requires evidence such as medical history, care or treatment, consistent assertion, or other proof that the identity is sincerely held as part of a person's core identity.
