relative to credits for assessments paid by insurers and relative to the application of criminal gambling statutes.

The fiscal note paragraph explaining the revenue impact of the NHLHIGA credit rate change and the sports wagering amendment was removed, as is standard when a bill reaches its final enrolled version.

The House version imposed a $10,000,000 aggregate annual cap on total credits all insurers could claim, with a pro-rata allocation system and 7-year carryforward for excess credits. The Senate version removed all of that and instead set a simple per-insurer rate: 20% per year for 5 years on existing assessments, and 10% per year for 10 years on new assessments made after the effective date.

The Senate added an entirely new Section 2 amending RSA 647:2, V(f) to exempt 'the conduct of a sports book, or participation in sports wagering, authorized by RSA 287-I' from criminal gambling prosecution. The House version contained no gambling-related provisions.

The Senate version creates a two-tier credit rate: assessments already paid keep the existing 20%-per-year-for-5-years rate, while any new or additional assessments made after the effective date are limited to 10% per year for 10 years. The House version applied a single 20%/5-year rate (when the aggregate cap was not reached) with no distinction between old and new assessments.

The House version had a single effective date of 60 days after passage for the entire bill. The Senate version splits this: the insurance credit section (Section 1) takes effect 60 days after passage, while the gambling statute amendment (Section 2) takes effect immediately upon passage.

The House version included detailed reporting requirements, a provision that deferred credits would not be treated as admitted assets, and a cap preventing any single insurer from recognizing more than 14.28% of the aggregate annual limitation from deferred credits. All of these were removed in the Senate version.

The introduced bill reduced the credit rate from 20% to 10% when total eligible credits exceeded $10 million in a year. The amended bill replaces this with a hard $10 million annual cap on total credits recognized by all member insurers combined, with excess amounts becoming deferred credits rather than being permanently lost.

Deferred credits (amounts exceeding the $10 million annual cap) can now be carried forward for up to 7 consecutive calendar years following the year they first became deferred. The introduced bill explicitly prohibited any carryforward or carryback of unused credits.

A per-insurer limit is added: no single insurer may recognize more than 14.28% of the $10 million aggregate annual limitation (approximately $1.428 million) from deferred credits in any calendar year, unless the commissioner determines strict application would materially impair orderly administration.

A new definitions section is added establishing formal meanings for 'eligible assessment credits,' 'aggregate annual limitation,' 'deferred credits,' and 'commissioner.'

When the $10 million cap is reached, each insurer's deferred credit amount is calculated proportionally based on their share of total deferred credits. Deferred credits are applied in the order they were accrued (first-in, first-out) and cannot be transferred, assigned, or conveyed except as authorized by statute.

Credits can only be applied after full calculation of tax liability under RSA 400-A and cannot reduce tax liability below zero. Insurers must report eligible and deferred credits in a form and manner prescribed by the commissioner.

The commissioner is given rulemaking authority under RSA 541-A to adopt rules necessary to implement and administer the section, which was not present in the introduced version.

The bill now repeals and reenacts the entire RSA 408-F:13 section rather than making targeted amendments, reflecting the substantial restructuring of the credit mechanism.
