relative to the issuance of no trespass orders on municipal or school district property.

Emergency NTOs now expire automatically no later than 35 days after issuance, down from 45 days.

The effective date is now split: the new review-and-rescind section takes effect one year after passage, while all other provisions take effect 60 days after passage (previously a single 60-day effective date for the entire act).

The duration of a continued NTO is now capped at a maximum of 1 year (previously had no stated cap).

A new section requires governing bodies to review all existing NTOs within 90 days and either reissue or rescind them; any NTO not acted upon within that window becomes automatically void.

The emergency NTO period was extended from 72 hours to 45 days before the governing body must formally approve continuation.

The hearing deadline changed from 'as soon as reasonably possible, but no later than 15 calendar days after the written request' to 'at the next regularly scheduled meeting,' which could be faster or slower depending on how often the body meets.

The vote required to continue an NTO beyond the initial period was lowered from a three-fifths supermajority to a simple majority, but now requires a roll call vote (named votes) rather than any voting method.

The emergency NTO content requirements were adjusted: the House required a statement that the order is temporary and subject to governing body review; the Senate instead requires a statement of the expiration date and time and notice of the right to request a hearing.

The House version's hard 90-day maximum on any administrative NTO was removed. The Senate version no longer sets an explicit statutory cap on total duration of an NTO.

The requirement that a governing body must seek a court-issued restraining order or other judicial relief to exclude someone beyond 90 days was removed entirely.

Emergency NTOs can now be issued by a person designated by the governing body, not just by the governing body itself. The original required a unanimous vote of the full governing body for any NTO; now a single designated person can issue an emergency order if immediate action is needed to protect public safety, prevent substantial disruption of operations, or prevent property damage.

The emergency NTO window was expanded from 24 hours to 72 hours before the governing body must vote to continue it.

New hearing deadlines were added: an individual must request a hearing within 10 days of issuance or approval, and the governing body must hold it within 15 calendar days of receiving the request. If the hearing is not held in time (and the delay is not the individual's fault), the NTO is automatically vacated.

The voting threshold for the governing body to continue an NTO beyond the emergency period was lowered from a unanimous vote to at least a 3/5 (three-fifths) vote.

The provision allowing a governing body to extend an NTO up to one year for repeat offenders (those who received a subsequent NTO for the same property within 2 years of a previous violation) was removed entirely.

The original sunset provision that automatically rescinded any NTO already in effect for more than 90 days on the law's effective date was removed, replaced by the general expiration rule.

A new general expiration rule was added: all NTOs expire by operation of law upon reaching their authorized duration and cannot be renewed except in full compliance with the section's requirements.
