relative to notice requirements regarding public employee suspensions and investigations and recognizing certain positions in the department of corrections as group II positions.

The bill now says positions 'shall be recognized by the division of personnel in the department of administrative services in the official record as group II' rather than 'shall be transferred to group II status in the New Hampshire retirement system.' This shifts the mechanism from a retirement system transfer to an administrative recognition in an official record.

The definitions section was rewritten. Instead of cross-referencing RSA 273-A:1, IX and X for the terms 'public employee' and 'public employer,' the bill now defines 'employer' as the state and any political subdivision, and 'public employee' or 'employee' as any person employed by the state or any subdivision, explicitly listing counties, cities, towns, precincts, water districts, school districts, and school administrative units.

The House version contained its own definitions of 'employer' and 'public employee' with a detailed list of covered entities. The Senate version replaced these with cross-references to existing definitions in RSA 273-A:1, IX (public employee) and X (public employer), aligning the bill with established statutory language.

The House version had a single effective date of 90 days after passage. The Senate version splits this: Section 1 (notice requirements) takes effect January 1, 2027, while Section 2 (retirement transfers) takes effect 60 days after passage.

The bill now applies to 'public employees' broadly defined to include state and local government workers (counties, cities, towns, precincts, water districts, school districts, and school administrative units), rather than only 'state employees' under the Department of Administrative Services.

The collective bargaining provision was flipped: the introduced version exempted all employees covered by CBAs entirely, while the amended version presumes the law applies to all public employees unless a CBA explicitly states otherwise.
