SB 17 requires health insurers and pharmacy benefit managers to count third-party charity payments (like patient assistance programs) toward a patient’s out-of-pocket cost-sharing (such as copays or deductibles) for prescription drugs. It applies to all plans covering prescriptions, except when a generic or interchangeable biological drug is available. Pharmacies must disclose details of such assistance to insurers if payments aren’t processed at the point of sale. High-deductible and catastrophic health plans are exempt until the patient meets their deductible. The law takes effect January 1, 2026.
