Section 3 was rewritten to clarify that the provisions of subsection 1 do not apply to contracts awarded by public utilities where the contractor has a collective bargaining agreement, project labor agreement, or a new worksite agreement related to significant operational or capital requirement projects.

A new category (c) was added to Section 3 defining worksite agreements that provide for construction or maintenance of significant operational or capital requirement projects.

The previous language limiting applicability to contracts with collective bargaining or project labor agreements with public utilities was replaced with more detailed language specifying the types of agreements that qualify.
