Removed the automatic authority for district boards of health in health districts to act as solid waste management authorities or administer public water systems.
Added a requirement for district boards to apply to the Division Administrator and demonstrate capability to be designated as solid waste management authorities.
Modified the definition of 'solid waste management authority' to exclude non-designated district boards, reserving the title for the Division or designated boards.
Added a requirement for the State Environmental Commission to adopt regulations establishing criteria for district boards to demonstrate their capability for designation.
Added provisions to ensure currently acting district boards are deemed capable and may continue their roles without re-application.
