LC 2621 Legislature · 2025 Regular Session

Revise the unit ownership act to allow a lower threshold for common element changes

This bill modifies Montana's Unit Ownership Act to allow a lower voting threshold for changing how undivided interests in common elements are allocated among unit owners. Under the current law, all unit owners must agree to alter these percentages, but the proposed change would require only 75% of unit owners to agree instead. This adjustment would affect condominium and homeowners association declarations by making it easier to update ownership percentages without unanimous consent. The bill amends Section 70-23-403 of the Montana Code Annotated to reflect this new 75% agreement requirement for amending interest percentages in common elements.
