Revise laws to clarify that local prohibitions on conveying family transfer parcels do not apply to conveyances involving lenders

This bill clarifies that Montana's existing laws exempting family transfers of land from subdivision review do not apply when lenders are involved in the conveyance. It amends state code to specify that divisions of land gifted or sold to immediate family members remain exempt from additional subdivision reviews, even if the transaction includes a lender, provided the land meets size and zoning requirements. The bill also allows family transfer parcels to be owned jointly with a spouse regardless of age and permits transfer of such parcels regardless of the recipient's age. Local governments retain authority to set reasonable fees for examining these divisions and must complete reviews within 20 working days.
