LC 1431 Legislature · 2025 Regular Session

Constitutional amendment to revise selection of certain judges and justices

This constitutional amendment would change Montana's selection process for Supreme Court justices from an election to an appointment by the Speaker of the House and Senate confirmation. It also modifies how vacancies in both the Supreme Court and district court are filled: the Governor would appoint a replacement from nominees (within 30 days), and the appointment must be confirmed by the Senate. If rejected by the Senate, the vacancy remains until filled through the new process. The amendment requires a two-thirds legislative vote and voter approval in the November 2026 election to take effect.
