SB 2438 Mississippi Senate · 2025 Regular Session

Mississippi State Employees Paid Parental Leave Act; enact.

SB 2438, the Mississippi State Employees Paid Parental Leave Act, would provide eligible state employees who are primary caregivers with six weeks (240 hours) of paid leave at 100% of their regular salary following the birth or adoption of a child. It applies to state employees (excluding K-12 teachers, higher education staff, and community college employees) and requires leave to be taken within 12 weeks of the event, with no carryover or payout upon separation. The paid leave would run concurrently with federal FMLA leave and not count against accrued personal or medical leave. School districts and community colleges would also be required to adopt similar paid parental leave policies for their employees.

MODERATE
The bill was significantly amended to exclude K-12 employees, public university employees, and community college employees from eligibility for paid parental leave, while also removing provisions for secondary caregivers. The original version allowed six weeks for primary caregivers and two weeks for secondary caregivers, but the current version only provides six weeks to primary caregivers. Additionally, the bill now requires public school and community college districts to adopt their own paid parental leave policies that match the state act's provisions.
Scope change
The bill's scope was narrowed by explicitly excluding K-12 employees, public university employees, and community college employees from state-paid parental leave eligibility, while adding a requirement for these districts to create their own matching policies.
ELIGIBILITY

Removed eligibility for K-12 employees, public university employees, and community college employees from receiving state-paid parental leave.

Eliminated provisions for secondary caregivers, removing the two weeks of paid leave that secondary caregivers could previously receive.

REQUIREMENT

Added requirement for boards of trustees of public school and community college districts to adopt paid parental leave policies matching the state act's provisions.

REPORTING

Added requirement for state agencies to submit annual reports to the State Personnel Board on paid parental leave usage starting July 1, 2026.

DEFINITION

Updated definitions to remove 'secondary caregiver' and clarify that eligible employees must be primary caregivers only.
