HR 9576 United States House · 119th Congress

National Fraud Enforcement Division Act of 2026

This bill creates a new National Fraud Enforcement Division within the Department of Justice to lead efforts against fraud targeting the federal government, federally funded programs, and American citizens. The division will be headed by an Assistant Attorney General appointed by the President and Senate, who will oversee complex investigations, guide local prosecutors, and coordinate with other federal agencies to stop organized fraud schemes. Additionally, the leader of this new unit will set national enforcement priorities and suggest legal or regulatory changes to fix systemic weaknesses that allow fraud to occur.

MODERATE
The Engrossed version of HR 9576 significantly weakens the National Fraud Enforcement Division compared to the Introduced version. The most notable changes are: (1) the head of the Division no longer requires Senate confirmation, instead being appointed under a lower-level mechanism and designated by the President; (2) the detailed list of seven specific duties was replaced with a single generic provision giving the Attorney General broad discretion to prescribe duties; and (3) a new political activity prohibition was added.
Scope change
The Division's operational scope was narrowed from a broadly defined mandate with seven enumerated duties to an open-ended role determined by the Attorney General, and the leadership appointment process was downgraded from Senate-confirmed to a presidential designation under a lower-level appointment authority.
REQUIREMENT

The head of the Division is no longer appointed by the President with Senate advice and consent. Instead, the position is filled under section 506 (a lower-level appointment authority) and designated by the President as the Assistant Attorney General for National Fraud Enforcement. This removes the Senate confirmation requirement.

SCOPE

The detailed list of seven specific duties (leading fraud investigations, overseeing multi-district cases, advising US Attorneys, coordinating with federal agencies, setting enforcement priorities, proposing legislative reforms, and advising on high-impact cases) was entirely removed and replaced with a single provision stating the head shall perform such duties as the Attorney General may prescribe. This gives the Attorney General broad discretion over the Division's role.

ENFORCEMENT

A new subsection adds the National Fraud Enforcement Division to the list of DOJ components subject to the political activity prohibition in section 7323(b)(3) of title 5, restricting employees from engaging in certain partisan political activities.

TECHNICAL

The establishment language changed from 'under the general authority of the Attorney General' to 'under the authority of the Attorney General,' and the Division's reference was narrowed from 'hereinafter referred to in this title' to 'referred to in this section.'

A clerical amendment subsection was added to insert a table of sections entry for the new section 509C in chapter 31 of title 28.
